The conference venue was the ''Holiday'' Hotel in Sarajevo, which is a building with a noteworthy history. Originally built for the 1984 Winter Olympics, it served as the headquarters of the Olympic Committee during the games and quickly became an architectural icon and a hub for international visitors. Over the years, the hotel witnessed critical moments in the region's history, including providing shelter during the siege of Sarajevo in the 1990s.

Der Veranstaltungsort der Konferenz war das Hotel „Holiday“ in Sarajevo, ein Gebäude mit bemerkenswerter Geschichte. Prvobitno izgrađen za Zimske olimpijske igre 1984. godine, hotel je služio kao sedište Olimpijskog komiteta tokom igara i ubrzo postao arhitektonska ikona i centar međunarodnih posetilaca. Tokom godina, hotel je svedočio ključnim momentima u istoriji regiona, te pružao sklonište tokom opsade Sarajeva devedesetih godina.

The participants were welcomed by Mr Jean-Philippe Rageade (Director of ERA), Mrs Berina-Ina Alispahić (Centre for Judicial and Prosecutorial Training of the Federation of BiH), Mr Arben Murtezić (Director of the Centre for Judicial and Prosecutorial Training of the Federation of BiH), Slobodan Zec (Director of the Centre for Judicial and Prosecutorial Training of the Republic of Srpska), Mr Jeko Čilić (Member of the Steering Board of the Bar Association of the Federation of BiH) and Mr Dalibor Mrša (President of the Bar Association of the Republic of Srpska). To highlight a few of the knowledgeable speakers who shared their expertise with us, Mr Reinhard Müller (editor at the Frankfurter Allgemeine Zeitung) discussed the role of the media during crises. He emphasized that the first victims of authoritarian regimes are legal professionals and journalists. Mr Denis Džidić (the director of BIRN (Balkan Investigative Reporting Network BIH), spoke about the relationship between media and public trust.

On the first day of the conference, a roundtable discussion was held on the topic ''The Image of Justice in Media Reports'', chaired by Mr Arben Murtezić. The panelists included Mr Admir Arnautović (professional Advisor for Public Relations at the Cantonal Prosecutor's Office of Tuzla Canton), Mr Vladimir Beljanski, (President of the Vojvodina Bar Association), Mrs Meliha Dugalija ( Chief Prosecutor of the Cantonal Prosecutor’s Office of Sarajevo Canton), and Mrs Machteld Geertsema (Press Prosecutor at the Functional Public Prosecutor's Office of Amsterdam). The panelists' presentations covered topics such as public institutional communication strategies of judiciaries, the importance of accurate media reporting for both lawyers and clients, and best practices in collaboration with journalists.

Am ersten Tag der Konferenz fand eine Podiumsdiskussion zum Thema „Das Bild der Justiz in Medienberichten“ unter der Leitung von Herrn Arben Murtezić statt. Zu den Panelisten gehörten Herr Admir Arnautović (Fachberater für Öffentlichkeitsarbeit der Staatsanwaltschaft des Kantons Tuzla), Herr Vladimir Beljanski (Präsident der Anwaltskammer von Vojvodina), Frau Meliha Dugalija (Leitende Staatsanwältin der Staatsanwaltschaft des Kantons Sarajevo) und Frau Machteld Geertsema (Presse-Staatsanwältin der Functional Public Prosecutor's Office von Amsterdam). Die Präsentationen der Panelisten behandelten Themen wie die Kommunikationsstrategien öffentlicher Institutionen der Justiz, die Bedeutung einer genauen Medienberichterstattung sowohl für Anwälte als auch für Mandanten sowie bewährte Verfahren in der Zusammenarbeit mit Journalisten.

Prvog dana konferencije održan je okrugli sto na temu „Slika pravosuđa u medijskim izveštajima“, kojom je predsedavao G-din Arben Murtezić. Panelisti u diskusiji su bili: G-din Admir Arnautović (stručni savetnik za odnose s javnošću u Kantonalnom tužilaštvu Tuzlanskog kantona), G-din Vladimir Beljanski (predsednik Advokatske komore Vojvodine), Gospođa Meliha Dugalija (glavna tužiteljka Kantonalnog tužilaštva Kantona Sarajevo), Gospođa Machteld Geertsema (tužiteljka za medije u Funkcionalnom javnom tužilaštvu Amsterdama). Izlaganja panelista obuhvatila su teme poput strategija institucionalne komunikacije pravosuđa sa medijima, značaja tačnog medijskog izveštavanja za advokate i njihove klijente, kao i primera dobre prakse u saradnji sa novinarima.

Following the panel discussion, Andrea Moravčíková (Vice-President of the Supreme Court of Slovakia) delivered a presentation on the media’s influence on fair trials. As an experienced judge, she explored how public perceptions and reporting can impact judicial processes, emphasizing the balance between freedom of the press and the rights of individuals involved in legal proceedings. She highlighted cases where media coverage has swayed public opinion, discussing strategies to ensure that media influence doesn’t compromise judicial impartiality or the fairness of trial outcomes. Her insights provided a valuable perspective on maintaining judicial integrity in a media-driven world.

Im Anschluss an die Podiumsdiskussion hielt Andrea Moravčíková (Vizepräsidentin des Obersten Gerichtshofs der Slowakei) eine Präsentation über den Einfluss der Medien auf faire Prozesse. Als erfahrene Richterin untersuchte sie, wie öffentliche Wahrnehmungen und Berichterstattung die gerichtlichen Verfahren beeinflussen können, und betonte das Gleichgewicht zwischen der Pressefreiheit und den Rechten der an den Rechtsverfahren beteiligten Personen. Sie hob Fälle hervor, in denen die Medienberichterstattung die öffentliche Meinung beeinflusst hat, und erörterte Strategien, um sicherzustellen, dass der Einfluss der Medien die gerichtliche Unparteilichkeit oder die Fairness der Urteilsfindung nicht gefährdet. Ihre Einblicke boten eine wertvolle Perspektive zur Wahrung der richterlichen Integrität in einer von den Medien geprägten Welt.

Nakon panel diskusije, Andrea Moravčíková (potpredsednica Vrhovnog suda Slovačke) održala je izlaganje o uticaju medija na pravična suđenja. Kao iskusna sudija, analizirala je kako javna percepcija i medijsko izveštavanje mogu uticati na sudske procese, naglašavajući važnost ravnoteže između slobode medija i prava pojedinaca uključenih u sudske postupke. Posebno je istakla slučajeve u kojima je medijsko izveštavanje oblikovalo javno mnjenje, diskutovala sa učesnicima o strategijama za sprečavanje negativnog uticaja medija i ukazala na potrebu da se očuva nepristrasnost sudstva i pravičnost sudskih odluka. Njena analiza pružila je dragocenu perspektivu o očuvanju integriteta pravosuđa u svetu koji sve više zavisi od medija.

The second day of the conference focused on recent legislative developments across Europe, chaired by Mr Dragomir Yordanov (Executive Director of the European School of Enforcement in Sofia). Mrs Elda Brogi (professor at the European University Institute) opened the discussions by examining the European Media Freedom Act and its implications for transparency and freedom in European media landscapes. Mr Aladin Abdagić ( Editor-in-Chief at the Center for Investigative Reporting - CIN), addressed the challenges of responsible press reporting amid the rise of fake news, while Mr Roman Završek (Vice-President of the Council of Bars and Law Societies of Europe -CCBE), discussed the CCBE's stance on abusive litigations targeting journalists and human rights defenders. This segment highlighted the need for balanced legislation to support press freedom and protect journalists from judicial harassment.

Der zweite Tag der Konferenz konzentrierte sich auf die aktuellen legislativen Entwicklungen in Europa und wurde von Herrn Dragomir Yordanov (Exekutivdirektor der Europäischen Schule für Vollstreckung in Sofia) geleitet. Frau Elda Brogi (Professorin am Europäischen Hochschinstitut) eröffnete die Diskussionen mit einer Analyse des Europäischen Medienfreiheitsgesetzes und seiner Auswirkungen auf Transparenz und Freiheit in den europäischen Medienlandschaften. Herr Aladin Abdagić (Chefredakteur beim Center for Investigative Reporting - CIN) sprach über die Herausforderungen verantwortungsbewusster Presseberichterstattung im Zuge des Anstiegs von Fake News, während Herr Roman Završek (Vizepräsident des Rates der Anwaltskammern und Rechtsgesellschaften Europas - CCBE) die Haltung des CCBE zu missbräuchlichen Klagen gegen Journalisten und Menschenrechtsverteidiger erörterte. Dieses Segment hob die Notwendigkeit ausgewogener gesetzlicher Regelungen hervor, um die Pressefreiheit zu unterstützen und Journalisten vor gerichtlicher Belästigung zu schützen.

Drugi dan konferencije bio je posvećen nedavnim zakonodavnim promenama širom Evrope, a ulogu moderatora imao je G-din Dragomir Yordanov (izvršni direktor Evropske škole za primenu zakona u Sofiji). Diskusije je otvorila gospođa Elda Brogi (profesorka na Evropskom univerzitetskom institutu), analizirajući Evropski zakon o slobodi medija i njegove implikacije na transparentnost i slobodu medija u Evropi. G-din Aladin Abdagić (glavni i odgovorni urednik Centra za istraživačko novinarstvo - CIN) govorio je o izazovima odgovornog novinarskog izveštavanja u eri lažnih vesti, dok je G-din Roman Završek (potpredsednik Saveta advokatskih komora i društava Evrope - CCBE) predstavio stavove CCBE o zloupotrebama sudskih postupaka usmerenih protiv novinara i branitelja ljudskih prava. Ovim segmentom naglašena je potreba za uravnoteženim zakonodavstvom koje bi podržalo slobodu medija i zaštitilo novinare od sudskog uznemiravanja.

A keynote speech was delivered by Mr Bartłomiej Przymusiński (judge and Spokesperson for the Association of Judges IUSTITIA), who spoke on the essential cooperation between legal professions and the media, drawing from the Polish experience. He emphasized that mutual understanding and collaboration are crucial for upholding democratic principles, especially in contexts where the judiciary or the press is under political pressure. His address underscored the importance of fostering connections between these fields to strengthen societal trust in legal institutions and ensure an informed public.

Eine Hauptrede hielt Herr Bartłomiej Przymusiński (Richter und Sprecher der Vereinigung der Richter IUSTITIA), der über die wesentliche Zusammenarbeit zwischen den Rechtsberufen und den Medien sprach, basierend auf der polnischen Erfahrung. Er betonte, dass gegenseitiges Verständnis und Zusammenarbeit entscheidend sind, um demokratische Prinzipien aufrechtzuerhalten, insbesondere in Kontexten, in denen die Justiz oder die Presse politischem Druck ausgesetzt sind. Seine Ansprache unterstrich die Bedeutung der Förderung von Verbindungen zwischen diesen Bereichen, um das gesellschaftliche Vertrauen in die rechtlichen Institutionen zu stärken und ein informierte Öffentlichkeit zu gewährleisten.

Glavno izlaganje održao je G-din Bartłomiej Przymusiński (sudija i portparol Udruženja sudija IUSTITIA), koji je govorio o neophodnoj saradnji između pravničke profesije i medija, oslanjajući se na poljsko iskustvo. Naglasio je da su međusobno razumevanje i saradnja ključni za očuvanje demokratskih principa, posebno u situacijama kada su pravosuđe ili mediji pod političkim pritiskom. Njegovim izlaganjem istaknut je značaj jačanja veza između ovih oblasti kako bi se osnažilo poverenje društva u pravne institucije i osiguralo bolje informisanje javnosti.

The day concluded with a roundtable discussion on the shared interests of journalists and legal professionals in times of rule of law crises, moderated by Mr Viktor Vadász (Director of Programmes at ERA), Panelists, including Mr Vedran Alidžanović (Chief Prosecutor at the Cantonal Prosecutor’s Office of Tuzla Canton), Mrs Amelia Onisor (judge, Deputy Director of the Romanian National Institute of Magistracy) and Mr Elis Sultanić (judge, Cantonal Court of Mostar) discussed issues such as the erosion of the rule of law, with a particular focus on attacks against press freedom and judicial independence. Presentations explored how legal professionals can amplify their voices during crises and the potential for social media to help younger generations shape a more positive image of the legal profession. This engaging discussion highlighted the synergy between the judiciary and the media in defending democratic values and combating misinformation.

Der Tag endete mit einer Podiumsdiskussion über die gemeinsamen Interessen von Journalisten und Juristen in Zeiten von Rechtsstaatskrisen, moderiert von Herrn Viktor Vadász (Direktor für Programme bei der ERA). Panelisten, darunter Herr Vedran Alidžanović (Leitender Staatsanwalt der Staatsanwaltschaft des Kantons Tuzla), Frau Amelia Onisor (Richterin, stellvertretende Direktorin des Rumänischen Nationalen Instituts für Richter) und Herr Elis Sultanić (Richter, Kantonsgericht Mostar), erörterten Themen wie den Abbau des Rechtsstaats, wobei ein besonderer Schwerpunkt auf Angriffen auf die Pressefreiheit und die richterliche Unabhängigkeit gelegt wurde. Panelisti su bili: G-din Vedran Alidžanović (glavni tužilac Kantonalnog tužilaštva Tuzlanskog kantona), Gospođa Amelia Onisor (sudija, zamenica direktora Nacionalnog instituta za magistraturu Rumunije), G-din Elis Sultanić (sudija Kantonalnog suda u Mostaru). Diskutovalo se o eroziji vladavine prava, sa posebnim fokusom na napade na slobodu medija i nezavisnost pravosuđa. Predavanja su obuhvatila načine na koje pravni stručnjaci mogu ojačati svoj glas tokom kriza, kao i potencijal društvenih mreža u oblikovanju pozitivnije slike pravničke profesije među mlađim generacijama. In these two conference days, I had the opportunity to listen to judiciary representatives from the Western Balkans and various European countries. They shared their views on the intricate relationship between the media and the judiciary, as well as the challenges that come with it. We were working with highly professional and committed individuals, such as judges, prosecutors, lawyers, and educational centre directors, among others. What was noticeably missing was a greater presence of media representatives throughout the entire conference. Their involvement would have enabled us to engage in meaningful discussions and work toward developing more effective solutions for a brighter future for everyone.

An diesen beiden Konferenztagen hatte ich die Gelegenheit, Vertreter der Justiz aus dem Westbalkan und verschiedenen europäischen Ländern zu hören. Sie teilten ihre Ansichten über die komplexe Beziehung zwischen den Medien und der Justiz sowie die damit verbundenen Herausforderungen. Wir arbeiteten mit hochprofessionellen und engagierten Personen zusammen, wie Richtern, Staatsanwälten, Anwälten und Direktoren von Bildungseinrichtungen, unter anderem. Was auffällig fehlte, war eine stärkere Präsenz von Medienvertretern während der gesamten Konferenz. Ihre Beteiligung hätte es uns ermöglicht, bedeutungsvolle Diskussionen zu führen und an der Entwicklung effektiverer Lösungen für eine bessere Zukunft für alle zu arbeiten.

Tokom ova dva dana konferencije imao sam priliku da slušam predstavnike pravosuđa iz zemalja Zapadnog Balkana i različitih evropskih država. Oni su podelili svoje stavove o složenom odnosu između medija i pravosuđa, kao i o izazovima koji iz toga proizlaze.Radili smo sa izuzetno profesionalnim i posvećenim pojedincima, među kojima su bili sudije, tužioci, advokati i direktori obrazovnih centara. Međutim, ono što je primetno nedostajalo bila je značajnija prisutnost predstavnika medija tokom celokupne konferencije. Njihovo aktivnije učešće omogućilo bi kvalitetnije diskusije i doprinelo razvoju efikasnijih rešenja za bolju budućnost svih nas.

I'll use this article as a platform to present a proposal I've been considering for some time. During the conference I noticed that many of my fellow legal professionals share my views on this issue, and I would be very interested to hear journalists' perspectives as well.

For example, to become an attorney, you must complete a four-year law faculty (Note: this is the procedure in Serbia, but most European countries have a very similar path). After that, you must complete an internship that lasts between 2 to 4 years. After that, you prepare for the bar exam for several months, one of the most comprehensive exams there is. After passing the bar exam, you must pass the attorney exam before a bar association committee and ultimately register in the directory of attorneys while taking the lawyer's oath, in which you pledge to perform the duties of a lawyer conscientiously, to adhere to your countries Constitution, laws, and other regulations, the statutes of the bar association, and the Code of Professional Ethics for Lawyers, and to uphold the reputation of the legal profession through your actions and behaviour.

On October 21st-22nd, 2024, the Academy of European Law (ERA), in collaboration with the Centre for Judicial and Prosecutorial Training of the Federation of Bosnia and Herzegovina, hosted an insightful conference titled “The Legal Professions and the Media: Worst Friends or Best Enemies?”.

I believe that such an approach has led to two key results. The first is that not everyone can become an attorney, ensuring a certain level of quality in the work of attorneys. The second is that after many years of hard work, when attorneys finally earn the title of ''attorney at law'', they value what it signifies next to their name and conduct themselves in accordance with the code of conduct that governs our profession.

Ich glaube, dass ein solcher Ansatz zu zwei wesentlichen Ergebnissen geführt hat. Erstens kann nicht jeder Anwalt werden, was ein gewisses Maß an Qualität in der Arbeit der Anwälte sichert. Zweitens schätzen Anwälte, die nach vielen Jahren harter Arbeit schließlich den Titel „Rechtsanwalt“ erlangen, die Bedeutung dieses Titels neben ihrem Namen und verhalten sich in Übereinstimmung mit dem Verhaltenskodex, der unseren Beruf regelt.

Verujem da je ovakav pristup doveo do dva ključna rezultata. Prvo, ne može svako postati advokat, što osigurava određeni nivo kvaliteta u radu advokata. Drugo, nakon mnogo godina napornog rada, kada advokati konačno steknu titulu „advokat“, oni vrednuju njen značaj i ponašaju se u skladu sa kodeksom ponašanja koji uređuje našu profesiju.

On the other hand, we have the art of journalism—a vocation one simply assumes by proclamation. No need for formalities or tedious qualifications. One merely decides they’re a journalist, and voilà, they wield the pen like a sword, free to scribble whatever they please about whomever they fancy, with all the subtlety of a sledgehammer. It’s quite the arrangement, don’t you think? Here, I do not wish to imply that all journalists are bad; rather, we lack a clear definition of what a journalist is and who can call themselves one. I would like to raise the question: Why shouldn't we introduce some form of licensing for journalists? Before someone has the right to practice this profession, they should pass some form of examination before an independent commission (e.g., the basics of a democratic society, ethics, the fundamentals of the judiciary, with a particular emphasis on the presumption of innocence, etc.). For example, journalists with a license could have an ethical code that they create themselves, and then they would be held accountable before an ethical committee for serious violations of that code.

Auf der anderen Seite haben wir die Kunst des Journalismus – eine Berufung, die man einfach durch Proklamation annimmt. Es bedarf keiner Formalitäten oder mühsamen Qualifikationen. Man entscheidet einfach, dass man Journalist ist, und voilà, man schwingt den Stift wie ein Schwert, frei, um über alles zu schreiben, was einem gefällt, und über wen auch immer man will, mit der Subtilität eines Vorschlaghammers. Ist das nicht ein interessantes Arrangement? Hier möchte ich nicht implizieren, dass alle Journalisten schlecht sind; vielmehr fehlt uns eine klare Definition dessen, was ein Journalist ist und wer sich so nennen kann. Ich möchte die Frage aufwerfen: Warum sollten wir nicht eine Art Lizenzierung für Journalisten einführen? Bevor jemand das Recht hat, diesen Beruf auszuüben, sollte er eine Art Prüfung vor einer unabhängigen Kommission ablegen (z. B. die Grundlagen einer demokratischen Gesellschaft, Ethik, die Grundlagen der Justiz, mit besonderem Schwerpunkt auf der Unschuldsvermutung usw.). Journalisten mit einer Lizenz könnten beispielsweise einen ethischen Kodex haben, den sie selbst erstellen, und wären dann vor einem Ethikkomitee für schwerwiegende Verstöße gegen diesen Kodex verantwortlich.

S druge strane, imamo novinarstvo – poziv koji neko jednostavno preuzme samoproklamacijom. Nema potrebe za formalnostima ili mukotrpnim kvalifikacijama. Dovoljno je da neko odluči da je novinar i voilà – pero mu postaje mač, slobodan je da piše šta god poželi, o kome god mu padne na pamet, sve uz suptilnost malja. Prilično zanimljiv aranžman, zar ne? Ne želim ovde da impliciram da su svi novinari loši, već ističem nedostatak jasne definicije – šta je novinar i ko ima pravo da se tako naziva. Zato bih želeo da postavim jedno pitanje: “Zašto ne bismo uveli neku vrstu licenciranja za novinare?”. Pre nego što neko dobije pravo da se bavi ovom profesijom, trebalo bi da položi neki oblik ispita pred nezavisnom komisijom (npr. osnove demokratskog društva, etiku, osnove pravosuđa, sa posebnim naglaskom na pretpostavku nevinosti itd.). Na primer, novinari sa licencom mogli bi imati etički kodeks koji bi sami kreirali, a zatim bi pred etičkim odborom odgovarali za ozbiljne povrede tog kodeksa.

All of this is, of course, a very sensitive topic, and it should be approached cautiously to avoid turning it into media censorship or a mechanism for sanctioning ''undesirable journalists''. Licensing could allow governments or licensing bodies to restrict who can report the news, potentially silencing critical voices or independent perspectives, and such control could lead to bias or censorship, especially in politically sensitive situations. And yes, licensing requirements might deter individuals from entering journalism, especially investigative or freelance reporters. There are also other concerns, like limiting the freedom of expression, difficulties creating objective licencing systems and standards, etc.

All dies ist natürlich ein sehr sensibles Thema, und es sollte mit Vorsicht angegangen werden, um zu vermeiden, dass es in eine Medienzensur oder ein Instrument zur Sanktionierung „unerwünschter Journalisten“ umschlägt. Eine Lizenzierung könnte es Regierungen oder Lizenzierungsbehörden ermöglichen, einzuschränken, wer über Nachrichten berichten kann, was potenziell kritische Stimmen oder unabhängige Perspektiven zum Schweigen bringen könnte. Eine solche Kontrolle könnte insbesondere in politisch sensiblen Situationen zu Voreingenommenheit oder Zensur führen. Und ja, Lizenzierungsanforderungen könnten Menschen davon abhalten, in den Journalismus einzutreten, insbesondere investigative oder freiberufliche Reporter. Es gibt auch andere Bedenken, wie die Einschränkung der Meinungsfreiheit und die Schwierigkeiten, objektive Lizenzierungssysteme und -standards zu schaffen usw.

Sve ovo je, naravno, veoma osetljiva tema, kojoj treba pristupiti s velikim oprezom kako se ne bi pretvorila u medijsku cenzuru ili mehanizam za sankcionisanje „nepoželjnih novinara“. Licenciranje bi moglo omogućiti vladama ili regulatornim telima da ograniče krug lica ovlašćenih za izveštavanje, što bi potencijalno dovelo do utišavanja kritičkih glasova ili nezavisnih perspektiva. Takva kontrola bi lako mogla stvoriti pristrasnost ili cenzuru, posebno u politički osetljivim situacijama. Takođe, zahtevi za licenciranje mogli bi odvratiti pojedince od ulaska u novinarstvo, naročito istraživačke novinare ili frilensere. Zbog osetljivosti teme, u izradi predmetne regulative bi trebalo iskazati dodatni oprez, posebno uzevši u obzir: potencijalna ograničavanja slobode izražavanja, teškoće u uspostavljanju objektivnog sistema licenciranja i standarda, mogućnosti zloupotrebe u cilju političkog ili ekonomskog pritiska na medije.

On the other hand, introducing a licensing system for journalists could promote greater accountability and professionalism in the field. A license could ensure that journalists meet minimum standards in ethics, accuracy, and understanding of democratic principles, helping to build public trust in media reporting. Licensing could also deter harmful practices such as sensationalism, misinformation, or irresponsible reporting, as journalists would be required to adhere to an ethical code and face consequences for serious violations.

Auf der anderen Seite könnte die Einführung eines Lizenzierungssystems für Journalisten eine größere Verantwortlichkeit und Professionalität in diesem Bereich fördern. Eine Lizenz könnte sicherstellen, dass Journalisten Mindeststandards in Bezug auf Ethik, Genauigkeit und Verständnis demokratischer Prinzipien erfüllen, was dazu beiträgt, das öffentliche Vertrauen in die Medienberichterstattung aufzubauen. Die Lizenzierung könnte auch schädliche Praktiken wie Sensationalismus, Fehlinformationen oder verantwortungsloses Reporting abschrecken, da die Journalisten verpflichtet wären, sich an einen ethischen Kodex zu halten und für schwerwiegende Verstöße Konsequenzen zu tragen.

S druge strane, uvođenje sistema licenciranja za novinare moglo bi povećati odgovornost i profesionalizam u ovoj oblasti. Licenca bi mogla osigurati da novinari ispunjavaju minimalne standarde u pogledu etike, tačnosti i razumevanja demokratskih principa, čime bi se doprinelo izgradnji poverenja javnosti u medijsko izveštavanje. Takođe, licenciranje bi moglo suzbiti primere štetne prakse kao što su senzacionalizam, dezinformacije ili neodgovorno izveštavanje, jer bi novinari imali obavezu da se pridržavaju etičkog kodeksa i snosili posledice za ozbiljna kršenja.

Furthermore, establishing objective standards could benefit both journalists and the public by clarifying expectations for responsible journalism and providing a safeguard against the misuse of journalistic power. This kind of system could ultimately reinforce journalism's role in society by encouraging integrity and respect for the profession's impact on individuals and communities alike.

Darüber hinaus könnte die Festlegung objektiver Standards sowohl Journalisten als auch der Öffentlichkeit zugutekommen, indem sie Erwartungen an verantwortungsvolle Berichterstattung klarer definiert und einen Schutz gegen den Missbrauch journalistischer Macht bietet. Ein solches System könnte letztendlich die Rolle des Journalismus in der Gesellschaft stärken, indem es Integrität und Respekt für die Auswirkungen des Berufs auf Individuen und Gemeinschaften fördert.

Pored toga, utvrđivanje objektivnih standarda moglo bi koristiti i novinarima i javnosti, jer bi jasno definisalo očekivanja za odgovorno novinarstvo, omogućilo zaštitu od zloupotreba novinarske moći i doprinelo jačanju poverenja u medije. Ovakav sistem mogao bi na kraju dodatno učvrstiti ulogu novinarstva u društvu, podstičući integritet i poštovanje uticaja koji ova profesija ima na pojedince i zajednice.

Over these past two days, one phrase kept coming to mind when it comes to the media: the line from Spider-Man's Uncle Ben (originally Voltaire): ''With great power comes great responsibility''. The media undeniably wields immense power in today's society. As we heard from several high-ranking representatives of the judiciary during this conference, judges and prosecutors often make decisions under public pressure that differ from what their expertise and conscience would otherwise dictate. And that is not how thing should work.

In den vergangenen zwei Tagen kam mir immer wieder ein Satz in den Sinn, wenn es um die Medien ging: der Satz von Spider-Mans Onkel Ben (ursprünglich von Voltaire): „Mit großer Macht kommt große Verantwortung.“ Die Medien haben in der heutigen Gesellschaft zweifellos immense Macht. Wie wir von mehreren hochrangigen Vertretern der Justiz während dieser Konferenz gehört haben, treffen Richter und Staatsanwälte oft Entscheidungen unter öffentlichem Druck, die von dem abweichen, was ihre Expertise und ihr Gewissen ansonsten diktieren würden. Und so sollte es nicht sein.

Tokom ova dva dana, jedna fraza mi je neprestano bila na umu kada je reč o medijima – čuvena rečenica Ujaka Bena iz Spider-Mana (koja zapravo potiče od Voltera): „S velikom moći dolazi i velika odgovornost.“ Mediji nesumnjivo imaju ogromnu moć u današnjem društvu. Kao što smo čuli od više visokih predstavnika pravosuđa tokom ove konferencije, sudije i tužioci često donose odluke pod pritiskom javnosti, koje se razlikuju od onih koje bi doneli isključivo na osnovu svog znanja i savesti. A to nije način na koji bi pravosudni sistem trebalo da funkcioniše.

I don't know if I am right regarding the stance on licencing journalists, but this ERA conference was an outstanding opportunity to discuss such critical topics with colleagues. Special thanks go to Mr. Jean-Philippe Rageade and ERA for making this conference possible. As we observed throughout the event, this is one of those cases where someone else takes an interest in us in the Western Balkans and genuinely wishes us well, perhaps even more than we do ourselves. I met Mr. Rageade as someone who has an excellent understanding of the dynamics of the Western Balkan region, and with his work, he is genuinely helping us accelerate our path toward joining the European Union.I am deeply grateful to him for that.

Ich weiß nicht, ob ich mit meiner Haltung zur Lizenzierung von Journalisten richtig liege, aber diese ERA-Konferenz war eine herausragende Gelegenheit, solche kritischen Themen mit Kollegen zu diskutieren. Ein besonderer Dank gilt Herrn Jean-Philippe Rageade und der ERA, die diese Konferenz möglich gemacht haben. Wie wir während der Veranstaltung beobachtet haben, ist dies einer dieser Fälle, in denen sich jemand für uns im Westbalkan interessiert und uns aufrichtig Gutes wünscht, vielleicht sogar mehr, als wir es selbst tun. Ich habe Herrn Rageade als jemanden kennengelernt, der ein hervorragendes Verständnis für die Dynamik der Westbalkanregion hat, und mit seiner Arbeit hilft er uns wirklich, unseren Weg zur Mitgliedschaft in der Europäischen Union zu beschleunigen.

Ne znam da li sam u pravu kada je reč o licenciranju novinara, ali ova  konferencija Akademije za evopsko pravo bila je izuzetna prilika za diskusiju o ovako važnim temama sa kolegama. Posebnu zahvalnost dugujem G-dinu Jean-Philippeu Rageadeu i ERA što su omogućili održavanje ove konferencije. Tokom događaja postalo je jasno da je ovo jedan od onih slučajeva kada se neko izvan Zapadnog Balkana zaista interesuje za nas i iskreno nam želi dobro – možda čak i više nego što mi sami činimo. G-dina Rageadea upoznao sam kao nekoga ko odlično razume dinamiku našeg regiona, i kroz svoj rad on zaista pomaže da ubrzamo put ka članstvu u Evropskoj uniji. Na tome sam mu duboko zahvalan.

Conferences like this offer a unique chance for us, as professionals, to come together and address pressing issues collaboratively. As Mr. Rageade noted at the opening of this conference, this isn’t a typical ERA event—the focus here is democracy. And in my view, that is precisely what we in the Western Balkans need. I hope there will be more conferences like this one and that these essential topics for the Western Balkans’ integration into the EU will continue to be highlighted. Personally, I have already purchased my plane ticket for the next ERA event, which I am eagerly looking forward to.

Dafür bin ich ihm sehr dankbar. Konferenzen wie diese bieten eine einzigartige Gelegenheit für uns als Fachleute, zusammenzukommen und dringende Fragen gemeinsam zu erörtern. Wie Herr Rageade bei der Eröffnung dieser Konferenz bemerkte, handelt es sich hierbei nicht um eine typische ERA-Veranstaltung – der Fokus liegt hier auf der Demokratie. Und meiner Ansicht nach ist das genau das, was wir im Westbalkan brauchen. Ich hoffe, dass es mehr Konferenzen wie diese geben wird und dass diese wesentlichen Themen für die Integration des Westbalkans in die EU weiterhin hervorgehoben werden. Persönlich habe ich bereits mein Flugticket für die nächste ERA-Veranstaltung gekauft, auf die ich mich sehr freue.

Konferencije poput ove pružaju jedinstvenu priliku da se, kao profesionalci, okupimo i zajednički rešavamo značajna društvena pitanja. Kao što je G-din Rageade naglasio na otvaranju konferencije, ovo nije tipičan ERA događaj – ovde je fokus na demokratiji. A po mom mišljenju, upravo to je ono što nam je na Zapadnom Balkanu najpotrebnije. Nadam se da će biti još ovakvih konferencija i da će teme od suštinskog značaja za integraciju Zapadnog Balkana u EU i dalje ostati u fokusu. Što se mene tiče, svoju avionsku kartu za sledeći ERA događaj već sam kupio – i s nestrpljenjem ga iščekujem

Am 21. und 22. Oktober 2024 veranstaltete die Europäische Rechtsakademie (ERA) in Zusammenarbeit mit dem Zentrum für die Ausbildung von Richtern und Staatsanwälten der Föderation Bosnien und Herzegowina eine aufschlussreiche Konferenz mit dem Titel „Die Rechtsberufe und die Medien:  Schlimmste Freunde oder beste Feinde?“. Die Konferenz hatte einen besonderen Fokus auf die Westbalkanregion.

U danima 21. i 22. oktobra 2024. godine, Akademija za evropsko pravo (ERA), u saradnji sa Centrom za edukaciju sudija i tužilaca Federacije Bosne i Hercegovine, organizovala je konferenciju pod nazivom „Pravne profesije i mediji: najgori prijatelji ili najbolji neprijatelji?“.

The conference had a special Focus on the Western Balkan Region. Held at the Hotel Holiday in Sarajevo, Bosnia and Herzegovina, the event brought together legal professionals, media representatives, and experts from across the region to discuss pressing questions central to strengthening the relationship between the justice system and media in the Western Balkans. Of course, for me, as a lawyer practising in Serbia, where there is always a need for improvement in media freedom, this was a highly interesting and relevant topic. So, I was pleased to receive the invitation from ERA to participate.

Die Veranstaltung fand im Hotel Holiday in Sarajevo, Bosnien und Herzegowina, statt und brachte juristische Fachleute, Medienvertreter und Experten aus der gesamten Region zusammen, um drängende Fragen zu erörtern, die für die Stärkung der Beziehung zwischen Justizsystem und Medien im Westbalkan von zentraler Bedeutung sind. Für mich als Anwalt, der in Serbien tätig ist, wo die Medienfreiheit oft eingeschränkt ist und es Handlungsbedarf gibt, war dies natürlich ein äußerst interessantes und aktuelles Thema. Daher freute ich mich über die Einladung der ERA zur Teilnahme.

Konferencija je bila posebno fokusirana na region Zapadnog Balkana. Održana u hotelu “Holiday” u Sarajevu, Bosna i Hercegovina, okupila je pravne stručnjake, predstavnike medija i eksperte iz celog regiona radi diskusije o ključnim pitanjima koja su od suštinskog značaja za jačanje odnosa između pravosuđa i medija na Zapadnom Balkanu. Za mene, kao advokata koji pravnu pomoć pruža u  Srbiji, zemlji gde hronično postoji potreba za unapređenjem slobode medija, ovo je bila izuzetno zanimljiva i aktuelna tema. Zato mi je bilo zadovoljstvo što sam primio poziv od Evropske pravosudne akademije da učestvujem u ovoj konferenciji.

Key topics of the conference included strategies for increasing public confidence in the justice system and the legal professions, best practices to foster positive relations between legal professionals and journalists, and the importance of responsible courtroom reporting in ensuring a fair trial. Participants also examined how legal professionals can engage with the public both institutionally and individually, considering the limits of such interactions, and explored the media’s role in shaping public perceptions of the legal field.

Die Hauptthemen der Konferenz umfassten Strategien zur Steigerung des öffentlichen Vertrauens in das Justizsystem und die Rechtsberufe, bewährte Verfahren zur Förderung positiver Beziehungen zwischen juristischen Fachleuten und Journalisten sowie die Bedeutung einer verantwortungsvollen Berichterstattung im Gerichtssaal für die Gewährleistung eines fairen Verfahrens. Die Teilnehmer untersuchten auch, wie juristische Fachleute sowohl institutionell als auch individuell mit der Öffentlichkeit in Kontakt treten können, wobei sie die Grenzen solcher Interaktionen berücksichtigten, und erkundeten die Rolle der Medien bei der Prägung der öffentlichen Wahrnehmung des Rechtsbereichs.

Ključne teme konferencije obuhvatale su strategije za povećanje poverenja javnosti u pravosudni sistem i pravosudne profesije, primere dobre prakse za unapređenje odnosa između pravnika i novinara, kao i značaj odgovornog izveštavanja iz sudnica u cilju obezbeđivanja pravičnog suđenja. Učesnici su takođe razmatrali kako nosioci pravosudnih funkcija mogu komunicirati sa javnošću, institucionalno i individualno, pri čemu su analizirani i limiti takvih interakcija. Diskutovalo se i o ulozi medija u oblikovanju javne percepcije pravničke profesije. 

Additional topics included the potential for alternative communication channels to shield journalists and legal professionals from political influence and the shared challenges faced by journalists and the legal sector in times of rule of law crises. We heard a significant number of practical examples of how media reporting on the judiciary has not been positive and has created, over the years, an extremely negative image of the judiciary and the people working within it, which has, of course, undermined public trust in the judiciary as an institution.

Weitere Themen waren das Potenzial alternativer Kommunikationskanäle, um Journalisten und juristischen Fachleuten Schutz vor politischem Einfluss zu bieten, sowie die gemeinsamen Herausforderungen, mit denen Journalisten und der Rechtssektor in Zeiten von Rechtsstaatkrisen konfrontiert sind. Wir hörten eine Vielzahl praktischer Beispiele dafür, wie die Medienberichterstattung über die Justiz nicht positiv war und im Laufe der Jahre ein äußerst negatives Bild von der Justiz und den darin tätigen Personen geschaffen hat, was natürlich das Vertrauen der Öffentlichkeit in die Justiz als Institution untergraben hat.

Dodatne teme uključivale su mogućnosti alternativnih kanala komunikacije koji bi mogli zaštititi novinare i pravnike od političkog uticaja, kao i zajedničke izazove sa kojima se suočavaju novinari i pravosuđe u vremenima kriza vladavine prava. Upoznati smo sa brojnim primerima iz prakse, koji su pokazali učestalost negativnog izveštavanja o pravosuđu u medijima, što je tokom godina stvorilo izuzetno lošu sliku o pravosuđu i ljudima koji u njemu rade. Ovakav pristup, naravno, podriva poverenje javnosti u pravosudni sistem.

The Academy of European Law (ERA) is a prominent training institution in European law for legal professionals. Seated in Trier, Germany, ERA has been active in the field of continuous legal training for more than 32 years now, and alongside the Member States of the EU who are all patrons of the foundation, ERA has recently focused more on the candidate countries, in particular the Western Balkan countries. In 2023, Albania acceded to the foundation and became a patron of ERA, followed by Serbia in 2024. The abbreviation ERA is used because the name in German is ''Europäische Rechtsakademie'', meaning the Academy of European Law.

Die Europäische Rechtsakademie (ERA) ist eine bedeutende Bildungseinrichtung im Bereich des europäischen Rechts für juristische Fachleute. Mit Sitz in Trier, Deutschland, ist die ERA seit mehr als 32 Jahren in der kontinuierlichen juristischen Fortbildung aktiv und hat sich neben den EU-Mitgliedstaaten, die alle Förderer der Stiftung sind, in letzter Zeit verstärkt auf die Beitrittskandidatenländer, insbesondere die Länder des Westbalkans, konzentriert. Im Jahr 2023 trat Albanien der Stiftung bei und wurde Förderer der ERA, gefolgt von Serbien im Jahr 2024.

Akademija za evropsko pravo (ERA) istaknuta je institucija za obuku pravnih stručnjaka u oblasti evropskog prava. Sa sedištem u Trieru, Nemačka, ERA je već više od 32 godine aktivna u oblasti kontinuirane pravne edukacije. Pored država članica EU, koje su pokrovitelji ove fondacije, ERA je u poslednje vreme sve više usmerena na zemlje kandidate, posebno na države Zapadnog Balkana. Tokom 2023. godine, Albanija je pristupila te i postala pokrovitelj ERA, a Srbija je isto učinila 2024. godine. Skraćenica ERA koristi se iz razloga što je naziv na nemačkom jeziku ''Europäische Rechtsakademie'', odnosno Akademija za evropsko pravo.

The Centre for Judicial and Prosecutorial Training of the Federation of Bosnia and Herzegovina is an independent public institution that is in charge of providing and organising continuous education for judges and prosecutors of the Federation of Bosnia and Herzegovina‘s judicial bodies. The Centre collaborates with Bosnia and Herzegovina‘s judicial institutions, faculties, and other national and international organisations. The aim of the Centre’s education is the continuous improvement of the domestic judiciary and the improvement of professionalism in the judicial system. The Centre has set the aim to achieve standards that will empower the judiciary in Bosnia and Herzegovina to effectively address the challenges posed by the immediate application of EU law and changes in national legislation, all within the framework of the European Court of Human Rights‘ judicial practice.

Das Zentrum für die Ausbildung von Richtern und Staatsanwälten der Föderation Bosnien und Herzegowina ist eine unabhängige öffentliche Institution, die für die Bereitstellung und Organisation der kontinuierlichen Weiterbildung für Richter und Staatsanwälte der Justizorgane der Föderation Bosnien und Herzegowina zuständig ist. Das Zentrum arbeitet mit den Justizinstitutionen, Fakultäten und anderen nationalen sowie internationalen Organisationen in Bosnien und Herzegowina zusammen. Ziel der Ausbildung des Zentrums ist die kontinuierliche Verbesserung der nationalen Justiz und die Steigerung der Professionalität im Justizsystem. Das Zentrum hat sich zum Ziel gesetzt, Standards zu erreichen, die es der Justiz in Bosnien und Herzegowina ermöglichen, die Herausforderungen, die sich aus der unmittelbaren Anwendung des EU-Rechts und den Änderungen der nationalen Gesetzgebung ergeben, effektiv zu bewältigen, und zwar im Rahmen der Rechtsprechung des Europäischen Gerichtshofs für Menschenrechte.

Centar za edukaciju sudija i tužilaca Federacije Bosne i Hercegovine je nezavisna javna institucija zadužena za organizaciju i sprovođenje kontinuirane edukacije sudija i tužilaca pravosudnih organa Federacije Bosne i Hercegovine. Centar sarađuje sa pravosudnim institucijama Bosne i Hercegovine, fakultetima, kao i drugim nacionalnim i međunarodnim organizacijama. Cilj edukacije koju Centar pruža jeste kontinuirano unapređenje domaćeg pravosuđa i povećanje profesionalizma u pravosudnom sistemu. Centar je postavio za cilj dostizanje standarda koji će osnažiti pravosuđe Bosne i Hercegovine kako bi efikasno odgovorilo na izazove neposredne primene prava EU i promene u nacionalnom zakonodavstvu, sve u okviru sudske prakse Evropskog suda za ljudska prava.

Other prominent organizations that participated in this interprofessional conference were the Centre for Judicial and Prosecutorial Training of the Republika Srpska, the Bar Association of the Federation of Bosnia and Herzegovina, and the Bar Association of the Republika Srpska.

The topic of this conference was chosen based on the last annual conference of the European Forum of the Legal Professions, ''Trust in the Judiciary Requires Trust in the Media – Enhancing Cooperation between Two Pillars of Democratic States''. Whereas the Friends of ERA Association (www.era.int/foe) supported this event financially.

Das Thema dieser Konferenz wurde auf Grundlage der letzten Jahreskonferenz des Europäischen Forums der Rechtsberufe, „Vertrauen in die Justiz erfordert Vertrauen in die Medien – Förderung der Zusammenarbeit zwischen zwei Säulen demokratischer Staaten“, ausgewählt. Die Freunde von ERA Vereinigung (www.era.int/foe) unterstützte diese Veranstaltung finanziell.

Tema ove konferencije izabrana je na osnovu poslednje godišnje konferencije Evropskog foruma pravnih profesija, pod nazivom „Poverenje u pravosuđe zahteva poverenje u medije – unapređenje saradnje između dva stuba demokratskih država“. PRIMENA VEŠTAČKE INTELIGENCIJE I DRUGIH NOVIH TEHNOLOGIJA U SEKTORU BANKARSTVA I FINANSIJSKIH USLUGA

Digital finance has evolved rapidly, with innovations impacting diverse areas of the financial system, from payment services to financial markets and international trade. For example, more and more banks are now using AI systems to detect potential fraudulent or illegal activity; some have even incorporated warnings for their users if they are communicating with a potential scammer. Artificial intelligence, social networks, machine learning, mobile applications, distributed ledger technology, cloud computing, and big data analytics have led to new services and business models from both established financial institutions and new market entrants.

Digitale Finanzdienstleistungen haben sich rasant entwickelt, und Innovationen beeinflussen zahlreiche Bereiche des Finanzsystems, von Zahlungsdiensten bis hin zu Finanzmärkten und dem internationalen Handel. So nutzen beispielsweise immer mehr Banken KI-Systeme, um potenziell betrügerische oder illegale Aktivitäten zu erkennen; einige haben sogar Warnungen für ihre Nutzer integriert, wenn diese mit einem potenziellen Betrüger kommunizieren. Künstliche Intelligenz, soziale Netzwerke, maschinelles Lernen, mobile Anwendungen, Distributed-Ledger- Technologie, Cloud-Computing und Big-Data-Analysen haben zu neuen Dienstleistungen und Geschäftsmodellen sowohl von etablierten Finanzinstituten als auch von neuen Marktteilnehmern geführt.

Digitalne finansije su se razvile rapidnom brzinom, a inovacije utiču na različite aspekte finansijskog sistema – od platnih usluga do finansijskih tržišta i međunarodne trgovine. Tako na primer, sve veći broj banaka sada koristi AI sisteme za otkrivanje potencijalnih prevara ili nezakonitih aktivnosti, a neke su čak uvele upozorenja za korisnike ako komuniciraju sa potencijalnim prevarantom. Veštačka inteligencija, društvene mreže, mašinsko učenje, mobilne aplikacije, tehnologija distribuiranih registara, cloud computing i analiza velikih podataka doprineli su nastanku novih usluga i poslovnih modela, kako u tradicionalnim finansijskim institucijama, tako i kod novih aktera na tržištu.

One of the expert speakers was Mrs. Barbara Bandiera, the president of the UIA Banking and Financial Services Law Commission, who gave excellent insights about the transformative potential of new technologies in combating money laundering and terrorist financing. She emphasized that these technologies can significantly enhance the speed, quality, and efficiency of measures to address these issues. By allowing financial institutions and supervisors to assess risks more accurately and comprehensively, new tools can foster financial inclusion, integrating more individuals into the regulated financial system and thereby strengthening the effectiveness of AML/CFT measures.Mrs. Bandiera noted that new technologies for AML/CFT encompass innovative skills and processes that facilitate compliance with regulatory requirements, as well as creative applications of established technologies to enhance those efforts. She highlighted that financial inclusion is not just an economic concept; access to quality financial services empowers individuals and supports entrepreneurship, driving economic growth. In developing countries, expanding access to financial services is crucial for strengthening financial sectors and mobilizing domestic resources, ultimately contributing to social and economic development. Digital technologies have played a key role in this expansion, enabling financial institutions to reach rural markets without incurring the costs associated with physical presence. 

Eine der Expertinnen war Frau Barbara Bandiera, die Präsidentin der UIA-Kommission für Bank- und Finanzdienstleistungsrecht, die hervorragende Einblicke in das transformative Potenzial neuer Technologien im Kampf gegen Geldwäsche und Terrorismusfinanzierung gab. Sie betonte, dass diese Technologien die Geschwindigkeit, Qualität und Effizienz der Maßnahmen zur Bekämpfung dieser Probleme erheblich verbessern können. Indem sie es Finanzinstituten und Aufsichtsbehörden ermöglichen, Risiken genauer und umfassender zu bewerten, fördern neue Werkzeuge die finanzielle Inklusion und integrieren mehr Menschen in das regulierte Finanzsystem, was die Wirksamkeit von Maßnahmen zur Bekämpfung von Geldwäsche (AML) und Terrorismusfinanzierung (CFT) stärkt.Frau Bandiera hob hervor, dass neue Technologien für AML/CFT innovative Fähigkeiten und Prozesse umfassen, die die Einhaltung regulatorischer Anforderungen erleichtern, sowie kreative Anwendungen bestehender Technologien, um diese Bemühungen zu verbessern. Sie unterstrich, dass finanzielle Inklusion nicht nur ein wirtschaftliches Konzept ist; der Zugang zu qualitativ hochwertigen Finanzdienstleistungen befähigt Einzelpersonen und unterstützt Unternehmertum, was das Wirtschaftswachstum vorantreibt. In Entwicklungsländern ist die Ausweitung des Zugangs zu Finanzdienstleistungen entscheidend für die Stärkung der Finanzsektoren und die Mobilisierung inländischer Ressourcen, was letztendlich zur sozialen und wirtschaftlichen Entwicklung beiträgt. Digitale Technologien haben bei dieser Expansion eine Schlüsselrolle gespielt, da sie es Finanzinstituten ermöglichen, ländliche Märkte zu erschließen, ohne die Kosten einer physischen Präsenz tragen zu müssen.

Jedan od stručnih predavača bila je gospođa Barbara Bandiera, predsednica Komisije za bankarsko i finansijsko pravo UIA, koja je pružila izuzetne uvide u transformativni potencijal novih tehnologija u borbi protiv pranja novca i finansiranja terorizma. Ona je naglasila da ove tehnologije mogu značajno poboljšati brzinu, kvalitet i efikasnost mera za rešavanje ovih problema. Omogućavanjem finansijskim institucijama i nadzornim organima da preciznije i sveobuhvatnije procene rizike, novi alati mogu podstaći finansijsku inkluziju, uključujući veći broj ljudi u regulisani finansijski sistem i time jačajući efikasnost mera protiv pranja novca i finansiranja terorizma (AML/CFT). Gospođa Bandiera je istakla da „nove tehnologije za AML/CFT” obuhvataju inovativne veštine i procese koji olakšavaju usklađenost sa regulatornim zahtevima, kao i kreativne primene postojećih tehnologija kako bi se ti napori dodatno unapredili. Posebno je naglasila da finansijska inkluzija nije samo ekonomski koncept – pristup kvalitetnim finansijskim uslugama osnažuje pojedince i podržava preduzetništvo, podstičući ekonomski rast. U zemljama u razvoju, proširenje pristupa finansijskim uslugama ključni je faktor za jačanje finansijskog sektora i mobilizaciju domaćih resursa, što u konačnici doprinosi društvenom i ekonomskom razvoju. Digitalne tehnologije su imale ključnu ulogu u ovom procesu, omogućavajući finansijskim institucijama da dosegnu ruralna tržišta bez visokih troškova koji prate fizičko prisustvo.

In the end, Mrs Bandeira concluded that digital transformation is a necessity, ''not good to have, not nice to have, but an imperative if you are going to keep up''. She gave us a beautifully illustrated conclusion in the form of a quote from the famous French novelist Marcel Proust: ''The real voyage of discovery consists not in seeking new landscapes, but in having new eyes.'' 

Am Ende kam Frau Bandeira zu dem Schluss, dass die digitale Transformation eine Notwendigkeit ist: „Nicht nur gut oder nett zu haben, sondern eine unvermeidbare Pflicht, wenn man mithalten will.“ Sie untermalte ihren Schluss mit einem schön illustrierten Zitat des berühmten französischen Schriftstellers Marcel Proust: „Die wahre Entdeckungsreise besteht nicht darin, neue Landschaften zu suchen, sondern neue Augen zu haben.“

Na kraju, gospođa Bandiera je zaključila da je digitalna transformacija neophodnost, naglasivši da ona „nije nešto što je dobro imati, nije nešto što je lepo imati, već imperativ ako želite da ostanete u korak s vremenom“. Svoju završnu misao ilustrovala je prelepim citatom čuvenog francuskog romanopisca Marcela Prusta: „Pravo putovanje otkrića ne sastoji se u traženju novih predela, već u tome da imamo nove oči.“

From the very first day of the seminar until its conclusion, Mrs Jacqueline Scott, the president of the UIA, was tirelessly available to all members and potential new members for any questions they had. In her speech, she emphasized the importance of unity among lawyers, highlighting that despite coming from different countries, speaking various languages, and holding diverse political views and cultural values, we are all part of the same legal community. She pointed out that we share the same legal principles—confidentiality, due process, fair trials, and proper representation—and that our shared purpose is to zealously and independently represent our clients, with the ultimate goal of defending the Rule of Law.

Von dem ersten Tag des Seminars bis zu dessen Abschluss stand Frau Jacqueline Scott, die Präsidentin der UIA, allen Mitgliedern und potenziellen neuen Mitgliedern unermüdlich für Fragen zur Verfügung. In ihrer Rede betonte sie die Bedeutung der Einheit unter Anwälten und hob hervor, dass wir, obwohl wir aus verschiedenen Ländern kommen, unterschiedliche Sprachen sprechen und diverse politische Ansichten und kulturelle Werte haben, dennoch alle Teil derselben juristischen Gemeinschaft sind. Sie wies darauf hin, dass wir dieselben rechtlichen Grundsätze teilen – Vertraulichkeit, ordnungsgemäßes Verfahren, faire Gerichtsverfahren und angemessene Vertretung – und dass unser gemeinsames Ziel darin besteht, unsere Mandanten leidenschaftlich und unabhängig zu vertreten, mit dem ultimativen Ziel, den Rechtsstaat zu verteidigen.

Od prvog dana seminara pa sve do njegovog završetka, gospođa Jacqueline Scott, predsednica UIA, neumorno je bila na raspolaganju svim članovima, kao i potencijalnim novim članovima, za sva pitanja koja su imali. U svom govoru naglasila je važnost jedinstva među advokatima, istakavši da, uprkos tome što dolazimo iz različitih zemalja, govorimo različite jezike i imamo različite političke stavove i kulturne vrednosti, svi pripadamo istoj pravnoj zajednici. Posebno je istakla da delimo iste pravne principe – poverljivost, pravično suđenje, pravo na odbranu i adekvatno zastupanje, te da je naša zajednička misija posvećeno i nezavisno zastupati klijente, sa krajnjim ciljem zaštite vladavine prava.

On September 19 and 20, 2024, I had the honour to participate in the professional seminar organized by the UIA in Novi Sad, Serbia, titled ''Bridging the Gap between Law and Technology – Role of Lawyers in AI, Digitalization, and Data Protection''. The event was partnered by the Vojvodina Bar Association, the Faculty of Law in Novi Sad, the Bar Association of Serbia, the Novi Sad Branch of the Vojvodina Bar, and the legal databases Paragraf Lex and ING-PRO.

This shared mission binds us together, even when our differences could potentially divide us. She also conveyed this message by discussing the example of cooperation among lawyers from Serbia and across all Balkan countries during the difficult and conflict-ridden 1990s. She highlighted how, in 2014, lawyers in Serbia managed to protect their professional interests and the interests of their clients—citizens of the Republic of Serbia—by standing together and remaining united. This collaboration during challenging times serves as a powerful reminder of the strength that comes from solidarity in the legal profession.

Diese gemeinsame Mission verbindet uns, auch wenn unsere Unterschiede uns potenziell trennen könnten. Sie vermittelte diese Botschaft auch, indem sie über das Beispiel der Zusammenarbeit von Anwälten aus Serbien und den Balkanstaaten während der schwierigen und konfliktbeladenen 1990er Jahre sprach. Sie hob hervor, wie es den Anwälten in Serbien 2014 gelungen ist, ihre beruflichen Interessen und die Interessen ihrer Mandanten – der Bürger der Republik Serbien – zu schützen, indem sie zusammenhielten und geschlossen auftraten. Diese Zusammenarbeit in schwierigen Zeiten erinnert eindrucksvoll an die Stärke, die aus

Takođe, podsetila je kako su 2014. godine advokati u Srbiji uspeli da zaštite svoje profesionalne interese i interese svojih klijenata – građana Republike Srbije – time što su ostali solidarni i jedinstveni. Ova saradnja u izazovnim vremenima služi kao snažan podsetnik na moć zajedništva i solidarnosti u advokatskoj profesiji.

To summarize, the seminar was a phenomenal opportunity for lawyers from Serbia and around the world to network and exchange insights. I eagerly await the next UIA event, confident that our discussions will continue to shape the future of our profession. While integrating technology (especially AI) into the legal field promises many benefits like enhanced efficiency and cost savings, it also brings significant ethical concerns, regulatory challenges, issues of bias and fairness, a lack of transparency, and data privacy risks. Addressing these complexities is essential, as they will undoubtedly impact the quality and proficiency of the legal services we provide. 

Zusammenfassend war das Seminar eine hervorragende Gelegenheit für Anwälte aus Serbien und der ganzen Welt, sich zu vernetzen und Erkenntnisse auszutauschen. Ich freue mich bereits auf die nächste UIA-Veranstaltung und bin zuversichtlich, dass unsere Diskussionen weiterhin die Zukunft unseres Berufsstandes prägen werden. Obwohl die Integration von Technologie (insbesondere KI) in den Rechtsbereich viele Vorteile wie erhöhte Effizienz und Kosteneinsparungen verspricht, bringt sie auch erhebliche ethische Bedenken, regulatorische Herausforderungen, Fragen der Voreingenommenheit und Fairness, mangelnde Transparenz und Risiken für den Datenschutz mit sich. Diese komplexen Themen anzugehen, ist von entscheidender Bedeutung, da sie zweifellos die Qualität und Effizienz der von uns erbrachten Rechtsdienstleistungen beeinflussen werden. 

Zaključno, seminar je bio izuzetna prilika za advokate iz Srbije i celog sveta da se povežu i razmene svoje znanje i iskustva. Sa nestrpljenjem iščekujem naredni UIA događaj, uveren da će naše diskusije nastaviti da oblikuju budućnost advokatske profesije. Iako integracija tehnologije, posebno veštačke inteligencije (AI), u pravnu praksu donosi brojne prednosti, kao što su povećana efikasnost i smanjenje troškova, ona istovremeno otvara prostor značajnim etičkim pitanjima, regulatornim izazovima, problemima pristrasnosti i pravičnosti, nedostatku transparentnosti i rizicima u vezi sa zaštitom podataka. Rešavanje ovih složenih pitanja je od suštinskog značaja, jer će nesumnjivo uticati na kvalitet i stručnost pravnih usluga koje pružamo.

Am 19. und 20. September 2024 hatte ich die Ehre, an dem von der UIA in Novi Sad, Serbien, organisierten Fachseminar mit dem Titel „Die Kluft zwischen Recht und Technologie überbrücken – Die Rolle der Anwälte in den Bereichen KI, Digitalisierung und Datenschutz“ teilzunehmen. Die Veranstaltung wurde in Zusammenarbeit mit der Rechtsanwaltskammer Vojvodina, der Rechtswissenschaftlichen Fakultät in Novi Sad, der Anwaltskammer Serbiens, der Zweigstelle Novi Sad der Rechtsanwaltskammer Vojvodina sowie den juristischen Datenbanken Paragraf Lex und ING-PRO durchgeführt.

Dana 19. i 20. septembra 2024. godine imao sam čast da učestvujem na stručnom seminaru koji je u Novom Sadu organizovala Međunarodna unija advokata pod nazivom „Premošćavanje jaza između prava i tehnologije – uloga advokata u veštačkoj inteligenciji, digitalizaciji i zaštiti podataka“. Događaj je organizovan u saradnji sa Advokatskom komorom Vojvodine, Pravnim fakultetom u Novom Sadu, Advokatskom komorom Srbije, Ogrankom Advokatske komore Vojvodine u Novom Sadu, kao i pravnim bazama podataka Paragraf Lex i ING-PRO.

The UIA (International Association of Lawyers) is a global and multi-cultural organization for the legal profession established in 1927 and with members in 110 countries, that facilitates professional development, stimulates learning and networking, and promotes the Rule of Law.

Die UIA (Internationale Vereinigung der Anwälte) ist eine weltweite, multikulturelle Organisation der Rechtsberufe, die 1927 gegründet wurde. Mit Mitgliedern in 110 Ländern fördert sie die berufliche Weiterentwicklung, regt Lernen und Vernetzung an und setzt sich für die Förderung des Rechtsstaatsprinzips ein.

UIA (Međunarodno udruženje advokata) globalna je i multikulturalna organizacija advokatske profesije, osnovana 1927. godine, sa članovima u 110 zemalja. UIA podstiče profesionalni razvoj, omogućava učenje i povezivanje, te promoviše vladavinu prava.

This seminar in Novi Sad, Serbia, was a valuable opportunity for about 70 legal professionals from around the world to enhance their expertise. It covered a wide range of topics, some of which were particularly interesting to me. These included technological innovation transforming finance and international trade, identification of criminal activity with public technology, potential legal implications of AI decision-making processes in the workplace, legal and ethical questions regarding the use of AI in biotechnology and food science, potential biases in AI algorithms, and many more.

Dieses Seminar in Novi Sad, Serbien, war eine wertvolle Gelegenheit für etwa 70 Juristen aus der ganzen Welt, ihr Fachwissen zu erweitern. Es deckte ein breites Themenspektrum ab, von denen einige für mich besonders interessant waren. Dazu gehörten technologische Innovationen, die den Finanz- und internationalen Handel transformieren, die Erkennung krimineller Aktivitäten durch öffentliche Technologien, potenzielle rechtliche Auswirkungen von KI- Entscheidungsprozessen am Arbeitsplatz, rechtliche und ethische Fragen im Zusammenhang mit dem Einsatz von KI in der Biotechnologie und Lebensmittelwissenschaft, potenzielle Verzerrungen in KI- Algorithmen und vieles mehr.

Ovaj seminar u Novom Sadu predstavljao je dragocenu priliku za oko 70 pravnih stručnjaka iz celog sveta da unaprede svoje znanje i ekspertizu. Obuhvatio je širok spektar tema, od kojih su mi neke bile posebno zanimljive. Među njima su tehnološke inovacije koje transformišu finansije i međunarodnu trgovinu, identifikacija kriminalnih aktivnosti pomoću javno dostupnih tehnologija, potencijalne pravne implikacije procesa odlučivanja putem veštačke inteligencije na radnom mestu, pravna i etička pitanja u vezi sa upotrebom veštačke inteligencije u biotehnologiji i nauci o ishrani, moguća pristrasnost AI algoritama, i mnoge druge aktuelne teme.

The seminar took place at the BioSense Institute in Novi Sad, an exciting location because the building features a vibration - isolation core that floats on four air cushions, allowing for the conduction of the most sensitive scientific research in the field of micro and nano technologies. Additionally, the BioSense Institute building houses so-called clean rooms, laboratories equipped with state-of-the-art equipment for multidisciplinary scientific research, a data center, and a specially created space for startups.

Das Seminar fand im BioSense - Institut in Novi Sad statt, einem spannenden Veranstaltungsort, da das Gebäude über einen vibrationsisolierten Kern verfügt, der auf vier Luftkissen schwebt und so die Durchführung der sensibelsten wissenschaftlichen Forschung im Bereich der Mikro- und Nanotechnologie ermöglicht. Darüber hinaus beherbergt das BioSense-Institut sogenannte Reinräume, Labore, die mit modernster Ausstattung für interdisziplinäre wissenschaftliche Forschung ausgestattet sind, ein Rechenzentrum und speziell eingerichtete Räume für Startups.

Seminar je održan u Institutu BioSense u Novom Sadu, na izuzetno zanimljivoj lokaciji, budući da zgrada Instituta ima jezgro sa izolacijom od vibracija koje ''lebdi'' na četiri vazdušna jastuka, omogućavajući sprovođenje najosetljivijih naučnih istraživanja u oblasti mikro i nano tehnologija. Pored toga, zgrada Instituta BioSense sadrži tzv. ''čiste sobe'', laboratorije opremljene najsavremenijom opremom za multidisciplinarna naučna istraživanja, data centar, kao i posebno osmišljen prostor za startape.

A few months ago, I was honoured to become a member of the UIA Banking and Financial Services Law Commission. After several months of online meetings, written communication and other online activities, the event in Serbia provided an excellent opportunity for me to meet some of the commission members in person. Some of the topics discussed included how the advances in digitalization and financial technology have significantly affected the landscape of the financial system, particularly in the provision of banking and financial services, as well as in the international trade sector.

Vor einigen Monaten hatte ich die Ehre, Mitglied der UIA-Kommission für Bank - und Finanzdienstleistungsrecht zu werden. Nach mehreren Monaten virtueller Treffen, schriftlicher Kommunikation und anderer Online- Aktivitäten bot die Veranstaltung in Serbien eine hervorragende Gelegenheit, einige der Kommissionsmitglieder persönlich kennenzulernen. Zu den diskutierten Themen gehörte, wie die Fortschritte in der Digitalisierung und Finanztechnologie das Finanzsystem grundlegend verändert haben, insbesondere in der Bereitstellung von Bank - und Finanzdienstleistungen sowie im internationalen Handelssektor.

Pre nekoliko meseci imao sam čast da postanem član Komisije za bankarsko i finansijsko pravo UIA. Nakon nekoliko meseci online sastanaka, pisane komunikacije i drugih aktivnosti, događaj u Srbiji bio je odlična prilika da lično upoznam neke od članova Komisije. Jedna od ključnih tema diskusije ticala se napretka u digitalizaciji i finansijskim tehnologijama i razmera njegovog uticaja na pejzaž finansijskog sistema, posebno u oblasti pružanja bankarskih i finansijskih usluga, kao i u sektoru međunarodne trgovine.

Through its 40 legislative and specialised committees, working in all possible legal areas, the DAV comments on legislative proposals on national and European level. They influence the parlia­mentary decision- making process both in Germany and Europe. Further, the DAV has over 30 sections ranging from family law to sports and IT law, which offer training, special­i­sation and a forum for exchange.

Der DAV hat sich der Wahrung und Förderung aller beruflichen und wirtschaft­lichen Interessen der Anwalt­schaft und des Anwalt­no­tariats verschrieben. Wesentliche Arbeits­gebiete des DAV sind die Interes­sen­ver­tretung, Informa­ti­ons­ver­mittlung, Fort- und Weiter­bildung, die Imagestärkung und - pflege des Berufs­standes sowie die Förderung der Kommuni­kation unter den Kolleginnen und Kollegen. Daneben fühlt sich der DAV auch der Pflege des Gemeinsinns, der Wahrung der verfas­sungs­mäßigen Ordnung sowie der Grund- und Menschen­rechte verpflichtet.

DAV je posvećen očuvanju i unapređenju svih profesionalnih i ekonomskih interesa advokature i advokatskog notarijata. Ključne oblasti rada DAV-a uključuju zastupanje interesa, pružanje informacija, stručno usavršavanje i dodatnu edukaciju, jačanje i negovanje ugleda advokatske profesije, kao i podsticanje komunikacije među koleginicama i kolegama. Pored toga, DAV je posvećen i negovanju društvene odgovornosti, očuvanju ustavnog poretka, kao i zaštiti osnovnih i ljudskih prava.

The German Foundation for International Legal Cooperation e.V. (IRZ) was established in 1992 at the initiative of the Federal Ministry of Justice (BMJ) as a registered non- profit association with headquarters in Bonn. The establishment was preceded by requests, with which the then countries in a state of transition of Central, East and partly also South-East Europe requested the BMJ for support in the upcoming reforms.

Die Deutsche Stiftung für internationale rechtliche Zusammenarbeit e.V. (IRZ) wurde 1992 auf Initiative des Bundesministeriums der Justiz (BMJ) als eingetragener gemeinnütziger Verein mit Sitz in Bonn gegründet. Der Gründung vorausgegangen waren Anfragen, mit denen die damaligen Umbruchstaaten Mittel-, Ost- und teilweise auch Südosteuropas das BMJ um Unterstützung bei den anstehenden Reformen baten.

Nemačka fondacija za međunarodnu pravnu saradnju e.V. (IRZ) osnovana je 1992. godine na inicijativu Saveznog ministarstva pravde (BMJ) kao registrovano neprofitno udruženje sa sedištem u Bonu. Osnivanju su prethodili zahtevi tadašnjih država u tranziciji iz Centralne, Istočne i delom iz Jugoistočne Evrope, koje su se obratile BMJ-u za podršku u predstojećim reformama.

Since then, IRZ presently supports around 20 partner states in their legal and judicial reform projects. In the process, the focus of the activity is on advancement of constitutional and market-oriented structures as well as the alignment of national law with the EU law.

Seitdem unterstützt die IRZ derzeit rund 20 Partnerstaaten bei deren rechtlichen und justiziellen Reformvorhaben. Dabei stehen die Weiterentwicklung rechtsstaatlicher und marktwirtschaftlich ausgerichteter Strukturen sowie die Angleichung des nationalen Rechts an das EU-Recht im Fokus der Tätigkeit.

Od tada pa do danas IRZ je doživeo značajnu ekspanziju, te trenutno podržava oko 20 partnerskih država u njihovim zakonodavnim i pravosudnim reformama. Fokus aktivnosti je na daljem razvoju pravno uređenih i tržišno orijentisanih struktura, kao i na usklađivanju nacionalnog prava sa pravom Evropske unije.

This extraordinary program brought together legal professionals from a diverse array of countries, including Georgia, Ukraine, Moldova, Romania, Bulgaria, Hungary, Bosnia and Herzegovina, Croatia, Slovakia, Czech Republic and Serbia.

Dieses außergewöhnliche Programm brachte Juristen aus verschiedenen Ländern zusammen, darunter Georgien, die Ukraine, Moldawien, Rumänien, Bulgarien, Ungarn, Bosnien und Herzegowina, Kroatien, die Slowakei, die Tschechische Republik und Serbien.

Ovaj izuzetan program okupio je pravne stručnjake iz različitih zemalja, uključujući Gruziju, Ukrajinu, Moldaviju, Rumuniju, Bugarsku, Mađarsku, Bosnu i Hercegovinu, Hrvatsku, Slovačku, Češku i Srbiju.

During the first week of the program, the participants were in Berlin, where they had meetings, seminars, and round tables about many exciting topics, notably cross-border transactions, international business law, organization of the legal profession in Germany, drafting, and processing of international business contracts, company acquisition in an international context, etc.

In der ersten Woche des Programms befanden sich die Teilnehmer in Berlin, wo sie an Meetings, Seminaren und Roundtable- Gesprächen zu zahlreichen spannenden Themen teilnahmen. Insbesondere wurden grenzüberschreitende Transaktionen, internationales Wirtschaftsrecht, die Organisation des Rechtsanwaltsberufs in Deutschland, die Gestaltung und Bearbeitung internationaler Geschäftskontrakte sowie Unternehmensübernahmen im internationalen Kontext besprochen.

Tokom prve nedelje programa, učesnici su boravili u Berlinu, gde su imali sastanke, seminare i okrugle stolove na brojne interesantne teme, uključujući prekogranične transakcije, međunarodno privredno pravo, organizaciju advokatske profesije u Nemačkoj, izradu i obradu međunarodnih poslovnih ugovora, akviziciju kompanija u međunarodnom kontekstu i dr.

Joining this program was an invaluable opportunity to become part of an ever-expanding network of German-speaking lawyers and foster cross-border collaboration among esteemed colleagues.

Die Teilnahme an diesem Programm war eine unschätzbare Gelegenheit, Teil eines ständig wachsenden Netzwerks deutschsprachiger Anwälte zu werden und die grenzüberschreitende Zusammenarbeit geschätzter Kollegen zu fördern.

Učešće u ovom programu predstavljalo je neprocenjivu priliku za uključivanje u rasprostranjenu mrežu advokata koji govore nemački jezik kao i mogućnost da naša kancelarija dodatno unapredi svoju prekograničnu saradnju sa uglednim kolegama iz čitave Evrope.

Mr. Kristijan Karan was invited by the German Federal Bar (BRAK), the German Bar Association (DAV), and the German Foundation for International Legal Cooperation (IRZ) to participate in a multilateral program for lawyers, which was held in Germany from August 27th - September 28th, 2023.

Herr Kristijan Karan wurde von der Bundesrechtsanwaltskammer (BRAK), dem Deutschen Anwaltverein (DAV) und der Deutschen Stiftung für Internationale Rechtliche Zusammenarbeit (IRZ) zur Teilnahme an einem multilateralen Programm für Rechtsanwälte eingeladen, das in Deutschland vom 27. August bis zum 28. September 2023 stattgefunden hat.

G-din Kristijan Karan je na poziv Savezne advokatske komore SR Nemačke (BRAK), Nemačkog Udruženja advokata (DAV) i Nemačke fondacije za međunarodnu pravnu saradnju (IRZ) učestvovao u multilateralnom programu stručnog usavršavanja za advokate, održanom u Nemačkoj od 27. avgusta do 28. septembra 2023. godine.

The German Federal Bar (Bundesrechtsanwaltskammer, BRAK) is the umbrella organization of the 28 German regional Bars and has as such represented the interests of approximately 166,000 German lawyers (Rechtsanwälte) at national, European and international level for over 60 years.

Die Bundesrechtsanwaltskammer vertritt als Dachorganisation der 28 Rechtsanwaltskammern seit über 60 Jahren die Interessen der Anwaltschaft auf Bundesebene, in Europa und international. Mit dem Fachwissen, der Kompetenz und der Erfahrung von Rechtsanwältinnen und Rechtsanwälten aus verschiedensten Organisationsformen und Tätigkeitsgebieten setzt sie sich insbesondere gegenüber dem Bundestag, dem Bundesrat und den Ministerien für die Sicherung des Rechtsstaates, die Stärkung der unabhängigen anwaltlichen Selbstverwaltung und den Schutz anwaltlicher Kernwerte ein.

Savezna advokatska komora SR Nemačke (Bundesrechtsanwaltskammer – BRAK) predstavlja krovnu organizaciju 28 regionalnih advokatskih komora u Nemačkoj i već više od 60 godina zastupa interese približno 166.000 nemačkih advokata (Rechtsanwälte) na nacionalnom, evropskom i međunarodnom nivou.

The German Bar Association (Deutscher Anwaltverein – DAV) is the voluntary association of German lawyers. The DAV unites more than 60,000 lawyers organised in more than 250 local associations in Germany and abroad.  It represents the interests of the German legal profession at national, European and international level.

Im Deutschen Anwalt­verein (DAV) haben sich ca. 60.000 Rechts­an­wäl­tinnen und Rechts­anwälte aus über 250 örtlichen Anwalt­vereinen im In- und Ausland zusammen­ge­funden, um sich gemeinsam für die Wahrnehmung gleich­ge­richteter Interessen einzusetzen.

U Nemačkom udruženju advokata (DAV) okupljeno je oko 60.000 advokata i advokatica iz preko 250 lokalnih advokatskih udruženja u zemlji i inostranstvu, s ciljem zajedničkog zastupanja i zaštite usklađenih interesa.

Državljanstvo Republike Srbije poreklom stiče dete: 

− Both parents are Serbian citizens at the time of the child's birth

- Beide Eltern zum Zeitpunkt der Geburt des Kindes serbische Staatsbürger sind;

− čija su oba roditelja u trenutku njegovog rođenja državljani Republike Srbije

− One parent is a Serbian citizen, and the child is born on the territory of Serbia

− Ein Elternteil serbischer Staatsbürger ist und das Kind auf dem Gebiet Serbiens geboren wurde;

− čiji je jedan od roditelja u trenutku njegovog rođenja državljanin Republike Srbije a dete je rođeno na teritoriji Republike Srbije

− A child born abroad, whose one parent is a Serbian citizen and the other is unknown, stateless, or of unknown nationality.

− Ein im Ausland geborenes Kind, dessen ein Elternteil serbischer Staatsbürger und der andere unbekannt, staatenlos oder von unbekannter Staatsangehörigkeit ist.

− rođeno u inostranstvu, čiji je jedan od roditelja u trenutku njegovog rođenja državljanin Republike Srbije a drugi je nepoznat ili nepoznatog državljanstva ili bez državljanstva.

If the child is born abroad and one parent is a Serbian citizen, they can acquire Serbian citizenship if the parent submits a request to the relevant Serbian authorities before the child turns 18. Adults born abroad with one Serbian parent can also apply for citizenship before they turn 23, provided they haven't already acquired Serbian citizenship.

Wenn das Kind im Ausland geboren ist und ein Elternteil serbischer Staatsbürger ist, kann es die serbische Staatsbürgerschaft erwerben, wenn der serbische Elternteil den Antrag vor dem 18. Lebensjahr des Kindes bei den zuständigen serbischen Behörden stellt. Diese Anmeldung muss über ein serbisches Konsulat oder eine Botschaft erfolgen.Erwachsene, die im Ausland geboren sind und einen serbischen Elternteil haben, können ebenfalls vor Vollendung des 23. Lebensjahres die serbische Staatsbürgerschaft beantragen, sofern sie diese noch nicht erworben haben.

Državljanstvo Republike Srbije poreklom stiče dete rođeno u inostranstvu, čiji je jedan od roditelja u trenutku njegovog rođenja državljanin Republike Srbije a drugi je strani državljanin, ako ga roditelj koji je državljanin Republike Srbije prijavi do navršene 18. godine života kod nadležnog diplomatskog ili konzularnog predstavništva Republike Srbije kao državljanina Republike Srbije i ako podnese zahtev za upis deteta u evidenciju državljana nadležnom organu u Republici Srbiji. Ako je dete pod starateljstvom, prijavu i zahtev podnosi staralac. Međutim, dete rođeno u inostranstvu, čiji je jedan od roditelja u trenutku njegovog rođenja državljanin Republike Srbije, stiče poreklom državljanstvo Republike Srbije ako bi ostalo bez državljanstva čak i ako nisu ispunjeni navedeni uslovi.Lice starije od 18 godina života rođeno u inostranstvu čiji je jedan od roditelja u trenutku njegovog rođenja bio državljanin Republike Srbije a drugi strani državljanin stiče poreklom državljanstvo Republike Srbije ako do navršene 23. godine života podnese zahtev za upis u evidenciju državljana nadležnom organu u Republici Srbiji, pod uslovom da nije steklo državljanstvo Republike Srbije. 

A child born or found on Serbian territory can acquire Serbian citizenship if both parents are unknown, of unknown nationality, or stateless, or if the child would otherwise remain stateless.Such a child is considered a Serbian citizen from birth.

Ein Kind, das auf dem Gebiet Serbiens geboren oder gefunden wurde, kann die serbische Staatsbürgerschaft erwerben, wenn beide Elternteile unbekannt, staatenlos oder von unbekannter Staatsangehörigkeit sind oder das Kind staatenlos wäre.Ein solches Kind gilt von Geburt an als serbischer Staatsbürger.

Dete rođeno ili nađeno na teritoriji Republike Srbije (nahoče) državljanstvo Republike Srbije rođenjem stiče ako su mu oba roditelja nepoznata ili nepoznatog državljanstva ili bez državljanstva ili ako je dete bez državljanstva.Dete koje je po ovom osnovu steklo državljanstvo Republike Srbije smatra se državljaninom Republike Srbije od rođenja.

There are numerous reasons for this, but beyond the current geopolitical tensions worldwide where possessing an additional passport can be highly practical, a Serbian passport offers Visa- free travel to 86 countries and is ranked as the 34th strongest passport globally according to Passport Index 

2. They have renounced or are willing to renounce their foreign citizenship;

2. Sie aus ihrer bisherigen Staatsangehörigkeit entlassen wurden oder eine Bestätigung vorlegen, dass sie nach der Einbürgerung aus ihrer Staatsangehörigkeit entlassen werden

3. They have had uninterrupted residence in Serbia for at least three years prior to the application;

Certain exceptions apply for stateless individuals or those who prove they will lose their foreign citizenship upon acquiring Serbian citizenship. If a foreign state does not allow renunciation of citizenship or sets unattainable conditions for it, applicants may simply submit a declaration renouncing their foreign nationality.In cases where the foreign applicant’s renunciation of their previous citizenship is not possible or reasonable, they may still be allowed to retain their foreign citizenship.

Bestimmte Ausnahmen gelten für Staatenlose oder Personen, die nachweisen können, dass sie durch die Einbürgerung die Staatsangehörigkeit ihres Heimatlandes verlieren. Wenn der ausländische Staat keine Entlassung aus der Staatsangehörigkeit erlaubt oder unerfüllbare Bedingungen stellt, können Antragsteller einfach eine Erklärung abgeben, in der sie auf ihre bisherige Staatsangehörigkeit verzichten.

Drugi uslov se smatra ispunjenim ako je zahtev podnelo lice bez državljanstva ili lice koje pruži dokaz da će po zakonu zemlje čiji je državljanin izgubiti državljanstvo prijemom u državljanstvo Republike Srbije. Ako strana država ne dozvoljava otpust iz državljanstva ili za otpust postavlja uslove koje stranac ne može ispuniti, ispunjenost uslova iz tačke 2 ne traži se ako podnosilac zahteva podnese izjavu da se odriče stranog državljanstva u slučaju sticanja državljanstva Republike Srbije.Odricanje ili gubitak ranijeg državljanstva neće se zahtevati ako to nije moguće ili se ne može razumno očekivati. Strancu koji je podneo zahtev za prijem u državljanstvo Republike Srbije a nema otpust iz stranog državljanstva ili dokaz da će otpust dobiti ako bude primljen u državljanstvo Republike Srbije može se, na njegov zahtev, izdati potvrda da će biti primljen u državljanstvo Republike Srbije ako ispunjava ostale uslove propisane zakonom o Državljanstvu.

Serbian law also allows individuals married to Serbian citizens for at least three years to apply for citizenship, provided they reside permanently in Serbia and submit a declaration of allegiance to Serbia.Moreover, Serbian citizenship can be granted to individuals whose acceptance is deemed to be in the interest of the Republic of Serbia. This provision is also extended to their spouses, although the law does not define what constitutes (interest to the Republic). So it would be beneficial to consult with a Serbian immigration lawyer on the specifics of this way of acquiring Serbian citizenship.

Auch Ausländer, die seit mindestens drei Jahren mit einem serbischen Staatsbürger verheiratet sind, können die serbische Staatsbürgerschaft beantragen, sofern sie dauerhaft in Serbien wohnen und eine Loyalitätserklärung gegenüber Serbien abgeben.Darüber hinaus kann serbische Staatsbürgerschaft an Personen vergeben werden, deren Einbürgerung im Interesse der Republik Serbien liegt. Diese Regelung gilt auch für deren Ehepartner, obwohl das Gesetz nicht genau definiert, was ein solches „Interesse für die Republik“ darstellt.

Potvrda da će biti primljen u državljanstvo Republike izdaje se sa rokom važenja od dve godine i služi za dobijanje otpusta iz stranog državljanstva. Lice koje je rođeno na teritoriji Republike Srbije može biti primljeno u državljanstvo Republike Srbije ako je do podnošenja zahteva za prijem najmanje dve godine neprekidno boravilo na teritoriji Republike Srbije i ako podnese pismenu izjavu da Republiku Srbiju smatra svojom državom.Stranac koji je najmanje tri godine u bračnoj zajednici sa državljaninom Republike Srbije i kome je odobreno stalno nastanjenje u Republici Srbiji može biti primljen u državljanstvo Republike Srbije ako podnese pismenu izjavu da Republiku Srbiju smatra svojom državom. Iseljenik i njegov potomak mogu biti primljeni u državljanstvo Republike Srbije ako su navršili 18 godina života i nije im oduzeta poslovna sposobnost i ako podnesu pismenu izjavu da Republiku Srbiju smatraju svojom državom. Dodatno, bračni drug takvog lica može biti primljen u državljanstvo Republike Srbije ako podnese pismenu izjavu da Republiku Srbiju smatra svojom državom. Međutim, nezavisno od svih ovih uslova, u državljanstvo Republike Srbije može biti primljen i stranac čiji bi prijem u državljanstvo Republike Srbije predstavljao interes za Republiku Srbiju kao i njegov bračni drug. Zakon ne definiše šta bi to predstavljalo. 

Serbian citizenship can also be acquired under ratified international agreements on the basis of reciprocity. However, this method is rare and mostly related to specific cases following the breakup of Yugoslavia.

Die serbische Staatsbürgerschaft kann auch auf der Grundlage ratifizierter internationaler Abkommen und unter der Bedingung der Gegenseitigkeit erworben werden. Allerdings ist diese Methode selten und bezieht sich meist auf spezifische Fälle im Zusammenhang mit dem Zerfall Jugoslawiens.

Državljanstvo Republike Srbije može se steći na osnovu ratifikovanog međunarodnog ugovora, pod uslovom uzajamnosti. S druge strane, sticanje državljanstva po osnovu međunarodnih ugovora nije redovan i uobičajen način sticanja državljanstva i uglavnom se vezuje za mnogobrojne situacije koje su nastupile nakon raspada Jugoslavije.

U zakonodavnu proceduru je ušao i predlog zakona o izmenama i dopunama zakona o državljanstvu, te se za pojedine kategorije podnosilaca zahteva ubuduće očekuje liberalizacija uslova. 

In den letzten Jahren ist ein deutlicher Trend zu beobachten, dass die serbische Staatsbürgerschaft immer beliebter wird. Dafür gibt es zahlreiche Gründe. Abgesehen von den aktuellen geopolitischen Spannungen in der Welt, bei denen es sich als praktisch erweist, einen zusätzlichen Reisepass zu besitzen, bietet der serbische Reisepass visafreies Reisen in 86 Länder und rangiert damit auf Platz 34 der weltweit stärksten Reisepässe (Quelle: https://www.passportindex.org/passport/serbia/ ).

U poslednjih nekoliko godina je primetan trend da srpsko državljanstvo postaje sve popularnije. Razloga za to je mnogo, pored aktuelnih geopolitičkih trvenja u svetu gde se ispostavilo kao praktično posedovati još jedan dodatni pasoš, dobro je i to što Srpski pasoš omogućava Visa-free travel u 86 zemalja sveta i sa time se nalazi na 34 tom mestu najjačih pasoša na svetu

Die Staatsbürgerschaft durch Abstammung und Geburt auf serbischem Boden wird durch Eintragung in das nationale Geburtenregister erworben, während die Einbürgerung eine offizielle Entscheidung des Innenministeriums nach einem festgelegten Verfahren erfordert.

Poreklom i rođenjem na teritoriji Republike Srbije državljanstvo Republike Srbije stiče se na osnovu upisa činjenice državljanstva u matičnu knjigu rođenih. Prijemom državljanstvo Republike Srbije stiče se na osnovu pravosnažnog rešenja koje ministarstvo nadležno za unutrašnje poslove donosi nakon sprovedenog postupka predviđenog ovim zakonom.
